YOU EXPRESSLY UNDERSTAND AND AGREE THAT LANDSET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Indemnification.

To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in Travis County, Texas.

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Landset regarding the Services.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Landset's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without Landset's prior written consent. Landset may assign these Terms without restriction.
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Landset.
Landset shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
